Terms of Service

1. Acceptance of terms

By creating an account or using the HaatBazar platform — whether through our website or mobile app — you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

HaatBazar is a peer-to-peer (C2C) marketplace: we connect independent buyers and sellers. HaatBazar is not a party to the sale of any item, does not own or inspect listed items, and does not process the sale price between buyer and seller. These terms apply to all users including buyers, sellers, and visitors.

2. Eligibility

You must be at least 16 years old to use HaatBazar. By using the platform you confirm that:

  • You are at least 16 years of age.
  • You have the legal capacity to enter into a binding agreement.
  • You are not prohibited from using the platform under applicable Nepali law.

3. Account registration

To buy or sell on HaatBazar, you must create an account. You agree to:

  • Provide accurate, current, and complete information.
  • Keep your account credentials secure and not share them with others.
  • Notify us immediately if you suspect unauthorised access to your account.
  • Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these terms or that are used for fraudulent purposes.

4. Buying on HaatBazar

When you browse and buy on HaatBazar:

  • Listings are created by individual sellers, not HaatBazar. Condition grades (A/B/C), photos, and descriptions are self-declared by the seller and not independently inspected or verified by HaatBazar.
  • To reserve an item, you pay a small reservation fee to HaatBazar through eSewa or Khalti. This fee goes to HaatBazar, not the seller, and holds the item for 48 hours while you arrange a meetup.
  • Paying the reservation fee opens a private chat where you and the seller can see each other's contact details to arrange a time and place to meet.
  • The item's sale price is paid directly to the seller — by cash, eSewa, Khalti, or bank transfer, as you and the seller agree. HaatBazar does not collect, hold, or process this payment.
  • Always inspect the item in person before paying the seller. Because HaatBazar is not a party to the sale, returns and refunds on the item itself are a matter between you and the seller — see our Privacy Policy for how this differs from the reservation fee.
  • HaatBazar is not responsible for the condition, authenticity, or legality of any item listed by a seller, or for how you use an item after purchase.

5. Selling on HaatBazar

When you list an item for sale on HaatBazar:

  • You create the listing yourself — photos, description, price, and a self-declared condition grade (A/B/C). Be accurate: buyers will inspect the item in person before paying you.
  • You confirm that you are the rightful owner of the item and have the right to sell it. Selling stolen, counterfeit, or prohibited goods is a criminal offence and will be reported to authorities.
  • Sellers with a confirmed email and phone number receive a Verified Seller badge on their listings.
  • When a buyer reserves your item, a private chat opens automatically with their contact details so you can arrange a meetup.
  • You are paid directly by the buyer — cash, eSewa, Khalti, or bank transfer, as you agree between yourselves. HaatBazar does not collect, hold, or forward your sale price at any point.
  • You may optionally boost a listing for a fee to feature it more prominently on the site and, at HaatBazar's discretion, on our social media — see Section 7 for fees.

6. Prohibited items

You may not list the following items on HaatBazar:

  • Stolen goods or items with removed/altered serial numbers
  • Counterfeit or replica goods
  • Weapons, ammunition, or explosive devices
  • Controlled substances or drug paraphernalia
  • Items that violate intellectual property rights
  • Hazardous materials
  • Adult content or items of a sexual nature

We reserve the right to remove any listing at our discretion. Attempting to sell prohibited items may result in account suspension and referral to law enforcement.

7. Fees and payments

HaatBazar does not take a commission on the sale price of any item — that payment happens directly between buyer and seller and never passes through HaatBazar. HaatBazar earns revenue from:

  • Reservation fees— a small fee (currently around 2% of the item's price) paid by the buyer to HaatBazar to reserve an item and unlock the seller's contact details.
  • Boosted listings — an optional fee sellers may pay to feature their listing more prominently on the site and, at our discretion, on our social media.
  • Vendor subscriptions — an optional paid tier for established second-hand shops and vendors, which includes a dedicated shop page on HaatBazar.

Reservation fees, boost fees, and vendor subscriptions are processed via eSewa or Khalti. We do not store your payment card details. Payment disputes relating to these fees should be raised with us within 48 hours; disputes about the item's sale price are between you and the other party.

8. Intellectual property

All content on the HaatBazar platform — including the logo, design, text, and code — is owned by or licensed to HaatBazar. You may not reproduce, distribute, or create derivative works without our written permission.

By submitting photos or content to the platform, you grant HaatBazar a non-exclusive, royalty-free licence to use that content for platform operations and marketing.

9. Limitation of liability

To the maximum extent permitted by Nepali law, HaatBazar is not liable for:

  • Indirect, incidental, or consequential damages arising from your use of the platform.
  • Loss of data, revenue, or profits.
  • The condition, authenticity, legality, or quality of any item listed by a seller, or any dispute between a buyer and seller over the item or its sale price — HaatBazar is not a party to that transaction.
  • Platform downtime or technical errors beyond our reasonable control.

Our total liability to you for any claim shall not exceed the total amount of platform fees (reservation, boost, or vendor fees) you paid to HaatBazar in the 3 months preceding the claim.

10. Dispute resolution

If you have a dispute with HaatBazar, please contact us first at support@haatbazar.com.np. We aim to resolve all disputes within 7 business days.

These terms are governed by the laws of Nepal. Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts of Kaski District, Gandaki Province, Nepal.

11. Changes to these terms

We may update these terms from time to time. Material changes will be communicated by email or platform notice at least 14 days before they take effect. Continued use of the platform after that date constitutes your acceptance of the updated terms.
